These Terms of Use ("Terms") govern your use of the MochiKey app ("the App"), provided by Kazuya Saito ("we", "us"). By downloading or using the App, you agree to these Terms and to Apple's applicable App Store terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and Apple's App Store terms.

2. The App Is a Toy

MochiKey is a tactile toy and custom keyboard for entertainment. It is not a medical device or therapy product. It does not diagnose, treat, or promise to reduce any health condition, and it is not intended to replace a full-featured input method.

3. Lifetime Pro Purchase

• Some Pro features require a paid one-time in-app purchase processed by Apple.
• The current version offers a lifetime unlock, not an auto-renewing subscription.
• "Lifetime" means access to the purchased Pro features for as long as the App is supported and those features are offered. It does not guarantee that the App, operating systems, third-party services, or every feature will be available forever.
• You can restore eligible purchases in the App using the Restore button.
• Payments, taxes, refunds, and purchase records are handled by Apple under Apple's terms. To request a refund, use Apple's refund process at reportaproblem.apple.com.

4. Keyboard Limitations

MochiKey depends on iOS custom keyboard behavior. It may not appear in secure text fields, phone-pad fields, or apps that disable third-party keyboards. The current keyboard extension does not request Full Access. Because of iOS sandboxing, some app settings or background changes may be limited by the system.

5. Your Content

Photos you set as keyboard backgrounds remain your content. You are responsible for having the rights to any image you use. We do not obtain ownership of your photos, and we do not permit use of the App to infringe third-party rights.

6. Acceptable Use

• Do not reverse engineer, copy, resell, or redistribute the App except as permitted by law.
• Do not use the App in a way that violates applicable laws or third-party rights.
• Do not attempt to bypass purchase verification or interfere with the App's operation.

7. Intellectual Property

The App, including its design, characters, illustrations, haptic patterns, and software, is owned by us or our licensors and is protected by applicable intellectual property laws.

8. Changes to the App and These Terms

We may update, change, or discontinue features of the App, and may revise these Terms. Material changes will be announced in the App or on this page. Continued use after changes take effect constitutes acceptance.

9. Disclaimer and Limitation of Liability

The App is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits rights that cannot be limited under applicable consumer law.

10. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, unless mandatory consumer protection law in your place of residence provides otherwise.

本利用規約（以下「本規約」）は、Kazuya Saito（以下「当方」）が提供するアプリ「もちキー / MochiKey」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約およびAppleのApp Store関連規約に同意したものとみなします。

第1条（利用許諾）

当方は、本規約およびAppleのApp Store関連規約に従うことを条件に、お客様が所有または管理するApple製デバイス上で本アプリを利用する、個人的・非独占的・譲渡不能・取消可能なライセンスを許諾します。

第2条（本アプリの性質）

本アプリは、触感を楽しむためのおもちゃおよびエンターテインメント目的のカスタムキーボードです。医療機器や治療を目的とした製品ではなく、健康状態の診断、改善、治療効果を約束するものではありません。また、高機能な日本語入力（IME）の代替を目的とするものではありません。

第3条（Lifetime Proの購入）

• 一部のPro機能の利用には、Appleが処理する有料の買い切りApp内課金が必要です。
• 現在のバージョンで提供するPro購入は、サブスクリプションではなく、自動更新はありません。
• 「Lifetime」は、本アプリがサポートされ、該当するPro機能が提供されている期間における利用権を意味します。本アプリ、OS、第三者サービス、または全機能が永久に提供されることを保証するものではありません。
• 対象となる購入は、本アプリ内の復元ボタンから復元できます。
• 支払い、税、返金、購入記録はAppleの規約に基づきAppleが処理します。返金は reportaproblem.apple.com から申請してください。

第4条（キーボード機能の制限）

本アプリはiOSのカスタムキーボード機能に依存しています。セキュア入力欄、電話番号入力欄、または第三者アプリが外部キーボードを無効化している場面では、本キーボードを利用できない場合があります。現在のキーボード拡張はフルアクセスを要求しません。iOSのサンドボックス制限により、一部のアプリ設定や背景変更の反映はシステムによって制限される場合があります。

第5条（お客様のコンテンツ）

キーボード背景に設定した写真はお客様のコンテンツです。使用する画像について必要な権利を確保する責任はお客様にあります。当方がお客様の写真の所有権を取得することはありません。また、第三者の権利を侵害する態様で本アプリを利用することはできません。

第6条（禁止事項）

• 法令で認められる場合を除く、本アプリのリバースエンジニアリング、複製、転売、再配布
• 法令または第三者の権利を侵害する態様での利用
• 購入検証の回避、本アプリの運営を妨害する行為

第7条（知的財産権）

本アプリ（デザイン、キャラクター、イラスト、触感パターン、ソフトウェアを含みます）に関する権利は、当方またはライセンサーに帰属し、関係法令により保護されています。

第8条（本アプリおよび本規約の変更）

当方は、本アプリの機能の更新・変更・提供終了、および本規約の改定を行うことがあります。重要な変更は本アプリ内または本ページで告知します。変更の効力発生後に本アプリの利用を継続した場合、変更に同意したものとみなします。

第9条（免責および責任の制限）

本アプリは「現状有姿」で提供され、法令で認められる最大限の範囲で、いかなる保証も行いません。法令で認められる最大限の範囲で、当方は本アプリの利用から生じる間接損害、付随的損害、結果的損害について責任を負いません。当方の責任の総額は、請求前12か月間にお客様が本アプリに支払った金額を上限とします。ただし、適用法上制限できない消費者の権利を制限するものではありません。

第10条（準拠法および管轄）

本規約は日本法に準拠します。本アプリに関する紛争については、お客様の居住地の強行法規である消費者保護法令が別段の定めをする場合を除き、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
