These Terms of Use ("Terms") govern your use of the MochiKey app ("the App"), provided by Kazuya Saito ("we", "us"). By downloading or using the App, you agree to these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and Apple's App Store Terms of Service.

2. The App Is a Toy

MochiKey is a tactile toy and a custom keyboard for entertainment. It is not a medical device or a therapy product. It does not diagnose, treat, or promise to reduce any health condition, and it is not intended to replace a full-featured input method.

3. Purchases and Subscriptions

• Some features ("Pro") require a paid purchase or subscription processed by Apple through your Apple Account.
• Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your device settings (Settings > Apple Account > Subscriptions). Deleting the App does not cancel a subscription.
• Prices may change; changes apply from the next billing period after notice through the App Store.
• Payments and refunds are handled by Apple under Apple's terms. To request a refund, use Apple's refund process at reportaproblem.apple.com.

4. Your Content

Photos you set as keyboard backgrounds are processed and stored on your device. We do not upload your photos to our servers. You are responsible for having the rights to any image you use.

5. Acceptable Use

• Do not reverse engineer, copy, resell, or redistribute the App except as permitted by law.
• Do not use the App in a way that violates applicable laws or third-party rights.
• Do not attempt to bypass purchase verification or interfere with the App's operation.

6. Intellectual Property

The App, including its design, characters, illustrations, haptic patterns, and software, is owned by us or our licensors and is protected by applicable intellectual property laws.

7. Disclaimer and Limitation of Liability

The App is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months before the claim.

8. Changes to the App and These Terms

We may update, change, or discontinue features of the App, and may revise these Terms. Material changes will be announced in the App or on this page. Continued use after changes take effect constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, unless mandatory consumer protection law in your place of residence provides otherwise.

本利用規約（以下「本規約」）は、Kazuya Saito（以下「当方」）が提供するアプリ「もちキー / MochiKey」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約に同意したものとみなします。

第1条（利用許諾）

当方は、本規約およびAppleのApp Store利用規約に従うことを条件に、お客様が所有または管理するApple製デバイス上で本アプリを利用する、個人的・非独占的・譲渡不能・取消可能なライセンスを許諾します。

第2条（本アプリの性質）

本アプリは、触感を楽しむためのおもちゃおよびエンターテインメント目的のカスタムキーボードです。医療機器や治療を目的とした製品ではなく、健康状態の診断、改善、治療効果を約束するものではありません。また、高機能な日本語入力（IME）の代替を目的とするものではありません。

第3条（購入およびサブスクリプション）

• 一部の機能（Pro）の利用には、Appleアカウントを通じてAppleが処理する有料購入またはサブスクリプション契約が必要です。
• 自動更新サブスクリプションは、現在の期間が終了する24時間以上前に解約しない限り、自動的に更新されます。
• サブスクリプションの管理・解約は、デバイスの設定（設定 > Appleアカウント > サブスクリプション）から行えます。アプリを削除しても解約にはなりません。
• 価格は変更される場合があります。変更はApp Storeを通じた通知後、次の請求期間から適用されます。
• 支払いおよび返金はAppleの規約に基づきAppleが処理します。返金は reportaproblem.apple.com から申請してください。

第4条（お客様のコンテンツ）

キーボード背景に設定した写真は、お客様のデバイス上で処理・保存されます。当方のサーバーに写真がアップロードされることはありません。使用する画像の権利は、お客様自身の責任で確保してください。

第5条（禁止事項）

• 法令で認められる場合を除く、本アプリのリバースエンジニアリング、複製、転売、再配布
• 法令または第三者の権利を侵害する態様での利用
• 購入検証の回避、本アプリの運営を妨害する行為

第6条（知的財産権）

本アプリ（デザイン、キャラクター、イラスト、ハプティックパターン、ソフトウェアを含む）に関する権利は、当方またはライセンサーに帰属し、関係法令により保護されています。

第7条（免責および責任の制限）

本アプリは「現状有姿」で提供され、法令で認められる最大限の範囲で、いかなる保証も行いません。法令で認められる最大限の範囲で、当方は本アプリの利用から生じる間接損害、付随的損害、結果的損害について責任を負いません。当方の責任の総額は、請求前12か月間にお客様が本アプリに支払った金額を上限とします。

第8条（本アプリおよび本規約の変更）

当方は、本アプリの機能の更新・変更・提供終了、および本規約の改定を行うことがあります。重要な変更は本アプリ内または本ページで告知します。変更の効力発生後に本アプリの利用を継続した場合、変更に同意したものとみなします。

第9条（準拠法および管轄）

本規約は日本法に準拠します。本アプリに関する紛争については、お客様の居住地の強行法規である消費者保護法令が別段の定めをする場合を除き、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
